DSK's Trial Part II : The facts To approach the facts of this case, we will analyze and interpret the different images of the video published, which give the chronological actions after the alleged assault. The starting of DSK * At 12:27 (twenty seven minutes past twelve), Dominique Strauss-Kahn leaves the elevator on the ground floor, pulling his suitcase, and stops at the reception desk. According to the video, he regulates his not and crosses the lobby at a rapid pace, but not hurried. Outside, an employee hails a taxi. DSK rises inside. The support of Nafissatou Diallo * At 12:51 (nine minutes to one), the maid comes out of an elevator, accompanied by her manager and a security guard at the Sofitel, Derrick May, who stops a moment at the reception. She seems to evoke her aggression to one of the security manager, Adrian Branch. She speaks and seems to mimic her ssault, pushing his colleague and touching her chest. The police call * At 1:33 p.m (twenty seven minutes to two), Adrian Branch calls the 911 (nine hundred and eleven), the police emergency number. "Sexual assault," he answers when asked the purpose of his call. "A maid attacked in a hotel, the Sofitel," he continues. * At 2:06 p.m (six minutes past two), the police arrives at the Sofitel. "Satisfaction dance" The most controversial and disturbing scene is held in the "loading deck".. We see Brian Yearwood and Derrick May enter this room while talking and suddenly without apparent reason congratulate themselves. The two men are delighted. For what reason? They affirmed they did not remember. They also said that at this time, they were unaware that the aggressor denounced by their colleague, Nafissatou Diallo, was the chief executive officer of the International Monetary Fund (IMF). According to information from Figaro, other members of the Sofitel team have suggested that the two employees could be satisfied that their colleague, Nafissatou Diallo, was agreed to alert the police for attempted rape. The arrest DSK is arrested by the police at 4:40 pm (twenty minutes to five) at the International Airport JFK shortly before take-off of Air France flight to Paris. The office of Manhattan District Attorney decides to initiate criminal and civil proceedings against DSK for seven charges, including two criminal sexual act, attempted rape, and sexual abuse. Before talking about the trial of DSK, it is necessary to analyze briefly the procedure in the US legal system. What happens at a civil trial in the United States? Contrary to what happens in France, criminal proceedings and civil proceedings are dissociated in the United States. In a civil trial, a judge is present and must ensure the proper conduct of case and a due process. Like in a criminal trial, a jury is required to rule on the case. In a criminal trial, we don't compensate the victim, the alleged guilty is punished with a sentence. Conversely, in a civil trial, the jury must determine whether the complainant has suffered an injury or not, and decide to repair it or not. Regarding DSK, the prosecutor has decided to initiate against him civil and criminal proceedings, which we will analyze in the next section.
